Daydash Terms of Service

Welcome to Axil LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our mobile application, Daydash (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions) to use the App. By using the App, you represent and warrant that you meet the eligibility requirements.

2. Accounts

  • You may need to create an account to access certain features.
  • You agree to provide accurate, current, and complete information during registration and to keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • We reserve the right to suspend or terminate your account if we believe you violated these Terms.

3. User Conduct

You agree not to:

  • Use the App for unlawful, harmful, or fraudulent purposes.
  • Attempt to disrupt, interfere with, or gain unauthorized access to the App or its systems.
  • Upload, transmit, or distribute content that is offensive, defamatory, or infringes on third-party rights.
  • Use automated systems (bots, crawlers, etc.) without our prior written permission.

4. Intellectual Property

  • All content, features, and functionality in the App (including text, graphics, logos, software) are owned by Axil LLC or our licensors and are protected by intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
  • You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5. Third-Party Services

The App may include links to or integrations with third-party services. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is subject to their terms.

6. Health and Wellness Data

  • DayDash may integrate with health data platforms such as Apple Health (HealthKit) and Android Health Connect to display your health and wellness information on your personal dashboard.
  • Health data displayed in the App is provided for informational purposes only. DayDash is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
  • You should not rely on health data displayed in DayDash to make medical decisions. Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment.
  • The accuracy of health data depends on your source devices, sensors, and the Apple Health or Health Connect platforms. DayDash is not responsible for inaccuracies in data provided by third-party sources.
  • By connecting health data sources, you acknowledge that you are voluntarily sharing your health information with DayDash for display and visualization purposes and, if you choose to use them, for the AI Assistant Features described in Section 7.

7. AI Assistant Features

DayDash includes optional AI features, including an AI assistant that can analyze the data on your dashboards (“AI Features”). The following terms apply when you use them:

  • Informational purposes only. Output generated by AI Features is provided for general information about your own data. It is not medical, financial, legal, or other professional advice, and it is not a substitute for advice from a qualified professional. Do not rely on AI output to make medical, financial, or legal decisions. Always consult a qualified professional for those matters.
  • AI output can be wrong. AI-generated responses may be inaccurate, incomplete, or misleading, even when they sound confident. We make no warranty as to the accuracy, completeness, or reliability of any AI output. You are responsible for verifying AI output and for any decisions or actions you take based on it.
  • Acceptable use. You agree not to attempt to bypass or defeat the AI Features’ safety measures; manipulate the assistant into producing advice or content it is designed to decline; inject instructions into the assistant through imported files, connected data sources, or other content; or use AI Features for any unlawful purpose. We may suspend or limit your access to AI Features if we believe you have violated this section.
  • Usage allowances. AI Features are available on eligible subscription plans, and the AI assistant is subject to a monthly usage allowance. When you reach your allowance, the AI Features that draw on it pause until the allowance resets. We may modify allowances, the underlying models, and the availability of AI Features, with reasonable notice where the change is material.
  • Your data. How AI Features handle your data is described in our Privacy Policy and in the disclosure shown in the App before you first use the assistant.

8. Subscriptions and Service Access

  • DayDash subscriptions may be purchased through our website at daydash.io or, where offered, as an in-app purchase through the Apple App Store or Google Play. The mobile app provides access to features and content included in your active subscription.
  • Subscriptions purchased on the website are billed, managed, and cancelled through the DayDash website. Subscriptions purchased as in-app purchases are billed by Apple or Google and must be managed and cancelled through your Apple or Google account settings.
  • We reserve the right to modify subscription plans, pricing, and included features with reasonable notice to subscribers.
  • For website purchases, refund policies are governed by the terms presented at the time of purchase on our website. For in-app purchases, refunds are handled by Apple or Google under the respective store’s policies.

9. Termination

We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you violate these Terms. Upon termination, your right to use the App will immediately cease.

10. Disclaimers

  • The App is provided on an “as is” and “as available” basis.
  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the App.
  • Our total liability to you for any claims arising out of or relating to the App will not exceed the amount you paid to us (if any) in the past 12 months.

12. Indemnification

You agree to indemnify, defend, and hold harmless Axil LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App will be resolved through binding arbitration administered in Travis County, Texas, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions or jury trials to the extent permitted by law.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Last Updated” date and, if appropriate, by providing additional notice (such as through the App or email). Your continued use of the App after changes take effect constitutes acceptance of the new Terms.
